A Timeline of Misconduct
The case against me is a blatant example of prosecutorial overreach, judicial bias, and a denial of fundamental constitutional rights. Below is a timeline of key events demonstrating the systemic failure of justice in my case:
- November 7 & 14, 2022 – Settlement agreements were finalized in both federal and state jurisdictions, dismissing all claims with prejudice.
- February 27, 2023 – A search warrant was issued against my Google account without an accompanying affidavit, raising constitutional concerns.
- November 17, 2023 – The Attorney General’s Office filed felony charges for Insurance Fraud & Check Forgery, strategically omitting the November 2022 settlement, while using materials from the settlement itself to construct a criminal case.
- April 11, 2024 – I discovered an outstanding arrest warrant during a routine background check.
- April 23, 2024 – I contacted the Attorney General’s Office, requesting the name of the judge who issued the warrant so I could seek to have it quashed, as the alleged Class 5 felony warranted only a summons, not an arrest.
- April 30, 2024 – I was arrested at home, despite being falsely portrayed as “at large.” The arrest affidavit deliberately omitted material facts, including the prior settlement that had resolved these claims.
- May 1, 2024 – I was released on PR bond. The Assistant AG admitted the charges were inflated and should have been consolidated.
- May 2, 2024 – The same Assistant AG filed 37 new felony counts, directly contradicting his earlier statement that charges should be consolidated.
- May 17, 2024 – Filed a Motion to Dismiss on the basis of legal insufficiency and prosecutorial misconduct.
- May 25, 2024 – The court denied my Motion to Dismiss without explanation.
- June 2, 2024 – The Attorney General added two additional charges, further exploiting affidavits from a civil settlement without proper verification. A key witness signed two affidavits before a notary, yet the AG’s investigation failed to acknowledge or correct this.
- September 19, 2024 –20 minutes before hearing my court assigned attorney informed me that the AG is offering a deal. I rejected that plea deal offering two years of deferred judgment with felony charges, as the case itself is baseless as I even do not know what check forgery as I never forged any check and I have been accused of.
- December 5, 2024 – The court assigned me a conflict-free attorney. The prosecutor claimed “extensive discovery” was available, yet discovery has been withheld.
- December 11, 2024 – Filed Pro Se Motions for a Franks Hearing (to challenge the validity of the arrest affidavit) and a Bill of Particulars (to demand specific details about the charges).
- December 24, 2024 – Filed a Supplemental Motion supporting my Franks Hearing request.
- December 26, 2024 – Filed a Motion to stay all proceedings pending the outcome of the Franks Hearing.
- December 30, 2024 – The court dismissed all my motions, arguing that since I had a court-appointed attorney, I could not file them myself. Yet, my attorney failed to file any motions on my behalf.
- January 17, 2025 – Filed a Notice of Removal to transfer the case to federal court due to judicial bias and lack of impartiality.
- January 30-31, 2025 – The case was remanded back by a Federal Judge who have previously served on the bench of the state appeal court. He sent the case to the wrong jurisdiction, creating a conflict over subject matter jurisdiction.
- January 31, 2025 – At my arraignment:
- Filed a Motion to Dismiss for due process violations, as the judge failed to follow proper procedures.
- Filed a Motion to Recuse the Presiding Judge, as it was his first time handling my case, yet he exhibited bias.
- Invoked my Right to Self-Representation (Farretta Right) since my attorney refused to challenge the prosecution, failed to refile my Franks Hearing request, and refused to file a Bill of Particulars.
- February 3, 2025 – Filed a Formal Request for a Farretta Hearing to assert my constitutional right to defend myself. The court has not responded.
- February 11, 2025 – Filed a Motion to Dismiss, asserting that neither jurisdiction has legal authority to prosecute this case, and a Motion to Compel the Court to rule on my outstanding motions.
